California Supreme Court agrees to hear Prop 8 challenges

SAN FRANCISCO –California‘s
highest court agreed Wednesday to hear several legal challenges to the
state’s new ban on same-sex marriage but refused to allow gay couples
to resume marrying before it rules.

The CaliforniaSupreme Court accepted three lawsuits seeking to nullify Proposition 8, a voter-approvedconstitutional amendment that overruled the court’s decision in May that legalizedgay marriage.

All three cases claim the measure abridges thecivil rights
of a vulnerable minority group. They argue that voters alone did not
have the authority to enact such a significant constitutional change.

As
is its custom when it takes up cases, the court elaborated little.
However, the justices did say they want to address what effect, if any,
a ruling upholding the amendment would have on the estimated 18,000
same-sex marriages that were sanctioned in California beforeelection day.

Gay rights groups and local governments petitioning to overturn the ban were joined by the measure’s sponsors andAttorney General Jerry Brown in urging the Supreme Court to consider whether Proposition 8 passes legal muster.

The initiative’s opponents had also asked the court to grant a stay of the measure, which would have allowedgay marriages to begin again while the justices considered the cases. The court denied that request.

The
justices directed Brown and lawyers for the Yes on 8 campaign to submit
arguments by Dec. 19 on why the ballot initiative should not be
nullified. It said lawyers for the plaintiffs, who include same-sex
couples who did not wed before the election, must respond before Jan. 5.

  2. Homosexuals want to be considered as having normal behavior by everyone through law.
    There is a difference be behavior choices and ones color of skin. Color of skin is not a choice but behavior is a choice.
    It is known as a fact that homosexuals do want children in school to be taught that their behavior is a normal behavior.
    Look at Rainbow ciriculum in CA and then a father getting arrested in MA after his 6 year old came home from school with a book that had pictures of homosexual partners and children as families. All he requested was that parents be informed and given a choice on whether their children should learn of such behavior in school.
    If that is not forcing life style behavior choices on others than what is?
    Homosexual behavior is not normal. Never has been and never will be. It doesn’t matter what kind of wrapping it is given. It has nothing to do with discrimination against a persons race and therefore should not be included as such and to do with civil rights.
    Also otherwise everyone has the rights already to live with whoever they want and to include whoever they want on their insurance policies, wills, and power of attorney forms, etc, etc, etc.
    This is not a civil rights issue. It is a behavior scceptance issue.
    Forcing everyone to accept something that is abnormal behavior to not think anything about it is what is wrong.

Sadly for you, you were born a complete and utter large-scale anal sphincter, but again it is something you are born with although for you and your ‘kind’ you CAN learn to be tolerant and accepting instead of self-loathing. It really works out alright if you open your microscopic and ever so narrow perception of the world.

  6. Hey, Marleena, if homosexual behaviour isn’t “normal,” then why do animals do it too? Ask the British naturalist Desmond Morris about that; one of his first projects as a graduate student — in the early1960s — was studying homosexuality in sticklebacks. Those are fish, in case the rest of your biology education is as deficient as your knowledge of human biology.

  7. Personally, I’m very much of the mind that it shouldn’t matter one whit whether it’s a choice, or innate. Either way, there still isn’t any good reason to deny them civil marriage, or any other civil rights that others enjoy. Because it’s not normal?? Please. I don’t have time for the list of all the other things that could be considered “abnormal” to which nobody objects.

There’s a pretty good article on the front page of this morning’s Los Angeles Times that hits all the important points – the basis of the court challenge (‘amendment’ vs ‘revision’ of the Constitution); the historical record of such previous challenges; the likelyhood (or unlikelyhood) of success; the timing and schedule for the review, and what that implies.

  10. Anna Quindlen at Newsweek wrote an eloquent essay {“The Loving Decision”) on why same-sex marriage is inevitable in the long run, which she wrapped up with this:
    The last word here goes to an authority on battling connubial bigotry. On the anniversary of the Loving decision last year, the bride wore tolerance. Mildred Loving, mother and grandmother, who once had cops burst into her bedroom because she was sleeping with her own husband, was quoted in a rare public statement saying she believed all Americans, “no matter their race, no matter their sex, no matter their sexual orientation, should have that same freedom to marry.” She concluded, “That’s whatLoving, and loving, are all about.”

  11. What I have witness from this is the absolute hatred that has been displayed by Gays, Lesbians and their supporters. When they can not get their way the stomp and scream and holler like children. We live in American people the majority sets the public policy and the majority has said that same-sex marriage is not a civil-right but a personal choice as it is.
    I can not believe how many people are deceived by the lies of Gays and Lesbian. We all have desires. For whatever reasons those who have same-sex attractions may not have control over who they are attracted to, but they have a choice rather to be controlled by their attractions or obedient to the moral laws of God. Love does not constituted something being right. Just because two people love each other does not make their actions moral. Adultery can take place between two people who have sincere attractions for each other and have even developed loving feelings between each other, but committing adultery is wrong.
    Homosexuality is not a civil right it is a moral dysfunction and the only way Gays and Lesbians will get their way is through the courts. They are not willing to heed the desires of the majority and therefore will never be accepted as normal no matter how they force their lifestyles on the majority.
    All of you who support same-sex marriage with have your day to answer to God and rather you believe in God or not He exist and He will have the last word. It is sad that so many people are willing to allow these people to destroy their souls to enjoy their own pleasures. America has become a nation of pleasure and can not stand to be denied that which one believes they must enjoy, because of pleasure.
    So sad.
    Even if Proposition 8 is overturned Gays and Lesbians lose. All this decision does is allow Gays and Lesbians to live in rebellion instead of pointing these people to get the mental help they need. It’s sad how Americans have become so willing to allow people to destroy their lives rather than speak the truth. Homosexuality is sin, no matter how acceptable it may become it’s still a sin to God and that is what really matters.
