I’m still a bit fuzzy headed from my minor kitty concussion BUT I had to provide some instant analysis of the DC Circuit Court’s unanimous ruling against Trump’s bonkers claim of absolute immunity.
From what I’ve seen of the ruling, the delay was caused by the judge’s desire to meticulously reject the Nixonian nonsense spouted by Trump’s lawyers. The three-judge panel’s goal was to promulgate an opinion that was bulletproof. Hence the longer than expected delay.
Team Trump has one week to file for cert from the Supremes. There’s a strong possibility that SCOTUS will decline to hear it and kick it back to Judge Chutkan for trial. That’s an inference I drew from SCOTUS’ denial to hear the case on an expedited basis. The three Obama and Biden appointees did NOT dissent from that ruling. Stay tuned.
A more detailed and hopefully erudite take on the opinion will have to wait until tomorrow. I want to read the opinion carefully and draw my own conclusions rather than running with the legal analyst pack. Besides, I’m not up to running today. Oh well, what the hell.
