Malaka Of The Week: Don West

I’m taking this feature in a slightly different direction; at least for this week. My preference is to write long and fairly detailed malaka of the week posts but sometimes I feel lazy. What can I say? I do this for free. But there’s always a lot of malakatude in the world, so this week Imma keep it short. Don West is the designated dickhead of the George Zimmerman defense team. Today he violated the prime directive/first rule of practicing law:never piss off the judgeeven if you’re convinced that you’re right.

  1. I love the tools who are all “she was out of line, this is grounds for a mistrial.”
    My sister works for the Federal court system as a law clerk; when I went home to visit, I got to tour her office and sit in on a court hearing. The prosecution had secured a plea deal, and the judge directly asked the defendant all of the same types of questions:
    Do you understand that you are waiving your right to a jury trial?
    Do you understand that by waiving your right to a trial, you will not have the opportunity to introduce evidence or call witnesses on your behalf?
    Do you understand that by waiving your right to a trial, you will not have the opportunity to testify on your behalf?
    Do you understand that by waiving your right to a trial, you will not have the opportunity to examine evidence or witnesses that would be introduced by the prosecution?
    Do you understand the contents of the plea agreement in front of you?
    Has anyone made any other kind of offer that is not contained in the plea agreement?
    Have you had the opportunity to ask your legal counsel any questions about the plea agreement?
    Have they answered the questions to your satisfaction?
    My sister told me that this happens all of the time. Far from a mistrial, it’s the exact opposite; it’s to establish as part of the record that the defendant understands what is going to happen to them as a result of the agreement, to minimize any possible avenues for review.
    But haters have gotta hope that their hero of the hour Zimmerman will be victorious; he got to live their dream of shooting a black kid, and if he doesn’t get away with it then they might not either.

  3. Especially if you’re convinced you’re right. There might be others in the courtroom with the power to rule otherwise.
