BOSTON –Massachusetts is suing thefederal government over a law that defines marriage as a union between a man and a woman.

State Attorney General Martha Coakley filed the lawsuit Wednesday in federal court in Boston. It says thefederal Defense of Marriage Act interferes with the right of Massachusetts to define marriage as it sees fit.

    On the upside, the potential Trojan horse of this case is that should the outcome in any way define marriage as a civil right extended to a citizen by the state, MA triggers not only the toppling of DOMA, but by extension, also casts as unconstitutional all other state laws that parallel DOMA (or at the very least, establishes legal precedent for subsequent actions).
    The difference between a kind of Balkanization of civil rights vs. wholesale toppling DOMA will be which emPHAsis on which sylLAble. See it?

    Rights are not granted by the state. They are existent, and recognized by the state as something not to be impinged upon.
