
The presumption of regularity is a venerable common law doctrine. Let’s get fancy and quote a Harvard Law Review article for a definition:
The presumption of regularity is a deference doctrine: it credits to the executive branch certain facts about what happened and why and, in doing so, narrows judicial scrutiny and widens executive discretion over decision making processes and outcomes.”
The presumption of regularity has eroded since the Insult Comedian’s return to power. The MAGA DOJ has repeatedly lied in its pleadings and in court, bad move. A growing number of federal judges are justifiably skeptical of the DOJ thereby undermining the presumption of regularity, which is rebuttable. Allow me to butt in and do some rebutting.
That brings me to the post title. A presumption of irregularity should be assumed by the courts and general public. It doesn’t just apply to the Bondi-Blanche cabal but to everything said by Team Trump. They’ve flipped the script with their incessant lying and do not deserve to receive the benefit of the doubt. In a word: Never.
The legacy media hasn’t learned this lesson. They still act as if the Trump regime might tell the truth when it never does. Instead of Trump said, the media should use the magic words: Trump claims. That goes for all his lackeys and minions, especially his wannabe successors JD Vance and Marco Rubio.
As to the general public, set your bullshit detector to maximum. Nothing that comes out of this regime has any credibility without independent verification. They’re the “boy who cried wolf” administration. They forfeited their credibility long ago and can never be trusted to be truthful. In a Spanish word; Nunca.
Applying the presumption of irregularity to everything coming from this regime is a way to stay sane in the face of insanity. They’ve turned a relatively normal country, topsy-turvy. Hence the featured image from Mike Leigh’s great movie about Gilbert and Sullivan, Topsy-Turvy.
The other side of this coin is the disinformation believed in by Team MAGA’s adversaries. The truth does not need to be stretched with this gangster regime. Embellishment is unnecessary, the facts are bad enough without being twisted. Be like Joe Friday on Dragnet, only without the right-wing politics, “Just the facts.”
The presumption of regularity is dead. Long live the presumption of irregularity.
