Sens. Lindsey Graham, R-S.C., and Sam Brownback, R.-Kan., called for release of documents when Supreme Court nominee Harriet Miers was White House counsel.
The Senate Judiciary Committee members broke with GOP colleagues who say executive privilege must not be pushed — an effort Vice President Cheney has spearhead for five years to strengthen presidential prerogatives, The Hill reported Wednesday.
Brownback said he would like to see Miers’ policy documents — not legal documents — from her term as White House counsel.
“Where there’s a close call, the tie goes toward disclosure,” Graham said.
Funny how Graham failed to discover that principle when John Roberts was up for confirmation.
