The Comey Indictment

Politics makes strange bedfellows is one of the first political aphorisms I learned. It doesn’t get much stranger than my support for James Comey as he faces a spurious indictment by the MAGA DOJ. I wrote scathingly about his intervention in the 2016 election, which inspired one of my all-time favorite titles, Easy Comey, Easy Go.

The featured image is of Comey side-by-side with his daughter Maurene. She’s another victim of the Insult Comedian’s petulant wrath. She was the lead prosecutor on the Ghislaine Maxwell case and was fired because her last name is Comey. She’s suing for wrongful termination. That’s how we do things in America. We resist tyranny through legal and nonviolent means.

The Comey indictment was a rush job. They had to beat the statute of limitations on Comey’s alleged offense, which is tomorrow. The case is a sure loser: It’s as if the Kaiser of Chaos asked, “What’s the weakest case we have against one of my enemies?”

The answer is Comey, Comey, Comey.

This fakakta case has been investigated three times and the only one who wanted to proceed was the idiot president. He had to dragoon a junior White House staffer to become acting US Attorney for the Eastern District of Virginia. Lindsey Halligan has no ties to Virginia or experience as a prosecutor. All that mattered was that she was a junior Trump defense lawyer and looks like a Fox News host. She’s a good little sycophant and did President Pennywise’s bidding.

Federal indictments are usually doorstops. This one was two pages presented by Halligan herself. It’s likely that other lawyers in the office wanted no part of this egregious ethical violation. In fact, they tried a three count indictment, but the grand jury refused to indict on one count. If only they’d showed the same fortitude about the whole case.

Repeat after me: There’s no there, there.

Comey is such a frustrating character that it’s easy to forget what a gifted communicator he is. Team Trump has handed him a megaphone, and he intends to use it.

The former FBI director seems determined to fight this fakakata case to the end. Note that I didn’t use bitter end because there’s not a snowball’s chance in hell he’ll be convicted. If I were on Comey’s legal team, I’d advise him to take one of two legal courses or a combination thereof.

  1. Move immediately for summary judgment with prejudice meaning the case cannot be brought again.
  2. In the federal system, defendants have the right to demand a speedy trial within 30 days: a fine way to take advantage of the disarray on the prosecution side.

If I were in Comey’s shoes, I’d choose #1 and make a vindictive and selective prosecution argument. But he may prefer to open door #2 and go for a speedy trial. A trial of the former FBI director would be an excellent way to focus attention on MAGA malfeasance.

That concludes the unsolicited and unneeded legal advice portion of the post. Team Comey knows its way around a courtroom whereas Lindsey Halligan needs Waze to find the courthouse.

The Comey indictment is an example of some of Trump’s most enduring traits: short-term thinking, impulsiveness, and stupidity. I hesitate to call what they brought against Comey a case, it’s more of a farce. The MAGA DOJ is known for making false claims in court, so they’re likely to tell the judge that the DOJ inspector general report exonerating Comey is a deep state plot. That may work on Twitter/X or at a MAGA rally, but not in the real world. It fails both the smell and laugh tests.

The good news is that federal district courts have held the line while SCOTUS has lost its collective mind. The 6 Republican appointees are aiding and abetting Trump’s crimes while hiding behind the shadow docket. As a SCOTUS history buff, it’s distressing to see it become an arm of the MAGA movement but that’s what it is.

There must be a SCOTUS reckoning, especially with Chief Justice Roberts who has thrown up his hands and thrown in with MAGA justices Thomas and Alito. I’m not sure whether to call it the Alito court or the MAGA court. It’s no longer the Roberts court.

Repeat after me: Blame it on John Roberts. Clarence and Sam are lunatics; Roberts is supposed to be the adult in the room. Instead, he’s joined in on the fascist hijinks.

Back to the Comeys. One of the best bits in the video is when the father quotes the daughter: “Fear is the tool of a tyrant, wielded to suppress independent thought.”

I may have mixed feelings about Jim Comey but not about Maurene. She’s a standup broad, as a noir guy that’s one of the nicest things I can say about any woman. Her firing is made even more odiferous by her role as the lead prosecutor in the Ghislaine Maxwell case. Maurene Comey understands Maxwell’s perfidy, certainly better than Todd Blanche or his client.

President Pennywise is already bragging that there are more indictments to come, specious ones no doubt. My response: Bring it on. Pushback is the only thing he understands. It worked in the Jimmy Kimmel mishigas: ABC, Sinclair, and Nextstar caved. Appeasement never works but pushback does.

In conclusion, allow me to shift into speechwriter mode:

Team MAGA wants its opponents to be scared and hide under the bed after wetting it. All that does is encourage them to ravage the constitution and the rule of law. Stand your ground. Never give an inch. Don’t fall into the fear trap they’ve laid for us.
